The COVID-19 national emergency has required many critical businesses to make significant changes to continue operating safely. Recognizing that these COVID-19 related modifications have made compliance with environmental regulatory and settlement-related obligations more challenging, or in some cases impossible, the U.S. Environmental Protection Agency and certain States have issued policies to address environmental compliance during the COVID-19 crisis. This presentation will cover key components of the EPA and select state (PA, OH, WV) policies, and will address important considerations for developing environmental compliance strategies during the ongoing pandemic.

About the Presenters:

Sean McGovern is a shareholder in the Environmental Services and the Energy & Natural Resources groups of Babst Calland. Mr. McGovern’s practice involves counseling clients on a variety of federal and state regulatory issues related to coal mining, as well as conventional, coal bed methane, Marcellus, Utica and other unconventional shale gas well development, production, midstream activities, storage and transportation in the Appalachian Basin.

Ben Clapp is an associate in the Environmental, Energy and Natural Resources, and Emerging Technologies groups of Babst Calland who advises clients on the environmental components of complex transactions, including identifying and analyzing significant environmental liability and compliance issues arising in connection with mergers and acquisitions, asset sales, securities offerings, project financings, and corporate restructurings.

Jorge Gutierrez is a partner located in the Dallas office of Reed Smith. Jorge is an oil and gas attorney who represents private and public exploration and production and midstream companies throughout the United States. He is certified in Oil, Gas and Mineral Law by the Texas Board of Legal Specialization.
