Since the TVA coal ash spill in December 2008, EPA has been promoting the beneficial re-use of coal combustion by-products, while at the same time investigating other coal ash impoundments and contemplating regulating coal ash as a hazardous waste. This presentation reviews the current state of play on this issue, including a detailed review of any EPA regulatory proposals which have been promised for issuance by the end of 2009.

8:15-9:00 a.m. Coal Versus Natural Gas: Is Price the Only Factor?
In 2009, total power generation declined for only the fourth year since 1949. This presentation explores why coal-fired generation absorbed more than the entire decline while gas-fired generation rose. Low gas prices can explain only a portion of the impact on coal. Declining industrial electricity demand also is a factor and is likely to play a major role in coal’s recovery.

The conference is being held at South Seas Island Resort, 5400 Plantation Road, Captiva Island, FL 33924

Captiva Island is reached via the Southwest International Airport in Fort Myers, Florida, approximately 45 minutes driving time from the airport via Sanibel Island. The EMLF room block is in the Resort’s hotel on the Harbour (inquire about villas and condos) at a rate of $249 single or double, plus $12.50 resort fee and 11% occupancy fee and 6% sales tax. Continuing Legal Education Credits
Conference accreditation is pending from states with mandatory Continuing Legal Education. Conference consists of 840 minutes, including 60 ethics minutes (14 hours in 60-minute states and 16.8 hours in 50-minute states). Registrants may be required to reimburse EMLF for MCLE filing fees for certain states. Please list the states or organization where you will be seeking professional education credits.

EMLF Registration Cancellation Policy
Refunds less a $100 administrative fee will be given for written registration cancellations received by January 9. No registration refunds will be made thereafter, but substitutions can be made without charge. Persons who must cancel their registration after January 9 may claim a $500 credit toward any future EMLF educational program.
